Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "your") and TradeGenetix ("we," "us," or "our"). By accessing or using the TradeGenetix website or purchasing any product, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use our website or services.

We reserve the right to update or modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the website following the posting of changes constitutes acceptance of those changes.

You must be at least 18 years of age to use our website or purchase our products. By using our website, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. You further represent that you are not prohibited from receiving our products or services under the laws of any applicable jurisdiction.

Individual Trading Strategies

TradeGenetix publishes individual automated trading strategies through its catalog at $249 per strategy. New strategies are added on a rolling basis. Each strategy targets a specific security and timeframe and is available for purchase at any time while listed in the catalog.

What You Receive

Each bundle includes platform-ready strategy code for NinjaTrader, TradeStation, MetaTrader 4/5, MultiCharts, PineScript (TradingView), ProRealTime, and IBKR Python, along with full performance documentation, setup instructions, and verified backtesting and forward-testing data.

Custom Strategy Development

We offer custom strategy development starting at $2,000 per strategy. Custom engagements are subject to a separate statement of work agreed upon by both parties prior to commencement.

Individual strategies are priced at $249 (USD) per strategy. This is a one-time purchase. There are no recurring fees, subscriptions, or account management charges associated with purchasing a strategy. All payments are processed through our third-party payment processor. You agree to provide accurate and complete payment information. All sales are final except as expressly provided in Section 5 (Guarantee and Refund Policy) below.

The 50-Trade Guarantee

Every strategy is backed by a 50-trade, 100% money-back guarantee. If the strategy does not pay for itself within the first 50 trades, you are entitled to a full refund or a free replacement strategy on the security of your choosing.

Risk of Ruin Trigger

If the program's modeled Risk of Ruin is triggered during the first 50 trades, you are also entitled to a full refund and a free replacement strategy, regardless of whether the $249 purchase price has been recovered.

Conditions

To qualify for a refund under the guarantee, you must meet the following conditions:

• Trade at the program's preset minimum account size with no intentional de-levering.
• Execute a minimum of 50 trades following the strategy's parameters.
• Take all trades in order with no skipping or cherry-picking in hindsight.
• If your results substantially differ from ours, we may request a verifiable brokerage statement (redacted for personally identifiable information) for review. We maintain live logs of all trades for comparison.

Refund Process

To request a refund, contact us through our Contact Us form (select "Refund Request") with your order number and a summary of your trading results. Refund requests are reviewed within fourteen (14) business days. Approved refunds are issued to the original payment method.

Ownership

All content on the TradeGenetix website, including text, graphics, logos, icons, images, and software, is the property of TradeGenetix and is protected by United States and international copyright, trademark, and other intellectual property laws.

License to Strategy Code

Upon purchase, you are granted a non-exclusive, non-transferable, perpetual license to use the strategy code contained in your bundle for your personal trading purposes. You may install and execute the code on the supported trading platforms for your own accounts.

Restrictions

You may not:

• Redistribute, resell, sublicense, or share the strategy code with any third party.
• Reverse-engineer, decompile, or attempt to extract the underlying proprietary logic of any strategy.
• Use the strategy code to operate a managed-account service, fund, signal service, or any other commercial product without prior written consent from TradeGenetix.
• Remove, alter, or obscure any proprietary notices, labels, or marks contained in the code or documentation.

Violation of these restrictions constitutes a material breach of these Terms and may result in immediate termination of your license, forfeiture of your refund eligibility, and pursuit of legal remedies.

TradeGenetix provides trading software. We are not a registered investment advisor, broker-dealer, or financial planner. Nothing on this website or in our products constitutes investment advice, financial advice, trading advice, or any other form of professional advice. We do not manage accounts, make trade recommendations on individual securities, or hold discretionary authority over client funds.

All trading decisions made using our products are your sole responsibility. You should consult with a qualified financial professional before making any investment decisions. Past performance, whether backtested or forward-tested, does not guarantee future results.

By purchasing and using our products, you acknowledge and accept the following:

• Day trading can be extremely risky and is generally not appropriate for someone with limited resources, limited trading experience, or low risk tolerance.
• You may lose all of the funds you use for trading, and in certain circumstances, you may lose more than your initial investment.
• The use of margin combined with unexpected price volatility can lead to losses that exceed your account balance.
• No automated trading strategy, including ours, can guarantee profits or eliminate risk.
• Markets evolve, and strategies that performed well historically may not perform well in the future.
• You are solely responsible for determining whether our products are suitable for your individual financial circumstances.

To the maximum extent permitted by applicable law, TradeGenetix and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, trading losses, or business interruption, arising out of or in connection with your use of our website, products, or services, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of our products shall not exceed the amount you paid to TradeGenetix for the specific product giving rise to the claim.

You agree to indemnify, defend, and hold harmless TradeGenetix and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of our website or products, your violation of these Terms, your violation of any applicable law or regulation, or your violation of any third-party rights.

Our website and products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, TradeGenetix disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any strategy will produce profits, avoid losses, or perform in any particular manner in live trading conditions.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or your use of our website or products shall be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.

Before initiating any formal legal proceeding, you agree to first attempt to resolve the dispute informally by contacting us through our Contact Us form. We will attempt to resolve the dispute through good-faith negotiation within thirty (30) days of receiving your written notice.

We reserve the right to suspend or terminate your access to our website and services at any time, with or without cause, and with or without notice. Upon termination for cause (such as a material breach of these Terms, including unauthorized redistribution of strategy code), your license to use any purchased strategy code is immediately revoked and you must destroy all copies in your possession. Termination does not relieve you of any payment obligations incurred prior to the date of termination.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TradeGenetix with respect to your use of our website and products. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and TradeGenetix regarding the subject matter herein.
